Counter-Notification

If you believe that material you posted on CarBuzz was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. For your counter-notification to be effective under the DMCA, it must be a written communication that includes substantially the following:  

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL(s)).  
  2. Your name, address, and telephone number.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.  
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which CarBuzz may be found, and that you will accept service of process from the person who provided the original infringement notification.

Upon Receipt of Counter-Notification:

After receiving a valid counter-notification, we may send a copy of the counter-notification to the original complaining party, informing them that we may replace the removed material or cease disabling access to it in 10 business days. We may then replace the removed material or cease disabling access to it in 10 to 14 business days or more following receipt of the counter-notification, unless our Designated Agent first receives notice from the person who submitted the infringement notification that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system or network.  

Repeat Infringers:

In accordance with the DMCA and other applicable law, CarBuzz reserves the right to terminate, in appropriate circumstances, the account or access of users who are determined to be repeat infringers.  

Changes to This Policy:

We may update this DMCA Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the “Last Updated” date.
